Rental Terms & Conditions
RESERVATIONS AND PAYMENTS:
Reservations can be made by telephone/online with a credit card 24 hours a day, or by regular mail, or in person seven days a week from 9am to 5pm. Your reservation must be confirmed by agent within 48 hours of any online booking. If it is discovered that subject rental property is already rented through another Broker or the owner and a replacement rental is needed then any deposit/fees shall be applied towards the new rental. All rentals are subject to a $25.00 administration fee and this must be paid with the initial deposit. This is non-refundable. Additionally, 50% ADVANCE RENTAL AMOUNT MUST BE RECEIVED WITHIN 10 DAYS OF THE BOOKING TO CONFIRM A RESERVATION. YOUR VACATION RENTAL AGREEMENT WILL BE CANCELLED WITHOUT NOTICE IF THIS IS NOT RECEIVED. A vacation rental agreement will be mailed to you after the reservation is made. This document will detail cost, due dates and policies. Receipt of a signed vacation rental agreement will be required prior to confirmation of your reservation. Reservation secured by credit or debit card can be cancelled with a full refund up to 10 days from initial payment. Thereafter, all cancellations will be subject to terms of the lease agreement. THE ENTIRE BALANCE OF YOUR VACATION RENTAL AGREEMENT AMOUNT IS DUE IN OUR OFFICE 30 DAYS PRIOR TO YOUR CHECK-IN DATE. Personal checks are acceptable for advance rental amounts and security deposits provided that check-in date is no less than 30 days away. If check-in date is within 30 days, all rental payments must be in form of a certified or cashier’s check, money order, MasterCard, Visa or Discover. Payments made via credit or debit card will incur a one time, non refundable $85 convenience fee. Since this type of payment IS a convenience and optional to the tenant, it is up to the tenant to satisfy these fees charged by Visa, Mastercard & Discover. Any payment made with a credit or debit card must have the leasehold named on the card. Also, a $25.00 fee will be charged to all returned checks and added to your balance. All advance rent amounts and security deposits, if applicable, will be deposited in our non-interest bearing trust account at Sun National Bank, Rt 72 Manahawkin, NJ. SECURITY/DAMAGE DEPOSIT:
Security deposit is payable in form of personal check, cashier's check, money order or cash except when check-in is within 30 days, then Security Deposit must be paid in guaranteed cash form. Security Deposit may not be paid by credit or debit card. Security Deposits shall be maintained by Prudential Zack Shore Properties and shall be returned to the Tenant within 30 days after check-out date so long as all rent is paid and the property is left undamaged and cleaned. If rent is due, or there is damage to the property, then the owner shall notify the Tenant and Prudential Zack Shore Properties in writing within the time prescribed by the Security Deposit Act, N.J.S.A. 46:8-19, concerning the amount of the security deposit the owner shall use to pay rent due, or to repair damage. In the event of a dispute between the Landlord and the Tenant concerning the deposit, Prudential Zack Shore Properties shall continue to hold the deposit until the parties agree as to the deposit's disposition or such disposition is ordered by a court of competent jurisdiction.
CANCELLATION POLICY:
Please note that in the event the Tenant wishes to cancel this lease, he/she shall make such request in writing to BROKER. Reservations secured by a credit or debit card can be cancelled with a full refund up to 10 days from initial payment. Thereafter, lease shall be terminated only after another Tenant is secured or permission from the owner is otherwise granted. Prudential Zack Shore Properties will not permit a refund (sometimes referred to as a “charge back”) after the said ten (10) day period. The $25.00 administration fee & commission fee of 12% of the total rental price shall be deducted from the deposit before it is returned to Tenant. If the lease was paid with a credit/debit card, the $85.00 convenience fee will also be retained by BROKER.
SIGHT UNSEEN RENTALS:
Prudential Zack Shore Properties is the leasing agent and is no way to be held liable for the negligence either of the Landlord or Tenant. Also, Prudential Zack Shore Properties makes no warranties either express or implied as to the physical or structural condition of the premises. We highly recommend that anyone signing a lease, personally inspect the property beforehand.
CHECK-IN/CHECK-OUT:
Check-in time is after 2:00 p.m. on the date of your arrival. For those arriving after office hours, arrangements should be made by telephone prior to arrival for key pick-up information. All rental payments and security deposit payments must be paid in full, in cash form for keys to be left for a late check-in. Check-out is by 11:00 a.m.
PETS:
Pets are NOT allowed in any rental unless otherwise stated in writing.
RESERVATION CONFIRMATION AND LEASE:
When your reservation is booked online Prudential Zack Shore Properties will confirm final availability within 48 hours. A lease agreement will be drawn and sent to you to be signed and returned within 10 days of the initial reservation. Unless some other arrangement is made within that time, the reservation shall be cancelled without notice if leases are not returned within the designated time period. At the moment of making a reservation, either online or with your agent, our rental system is updated real time but due to owner changes, removal of rentals from our inventory, different broker reservations, mechanical problems we cannot absolutely guarantee a specific rental. If a reservation is discovered to be unavailable, you will have the option to book a different time frame in same rental or agent shall work with you to identify a replacement rental with any deposit/fees already paid to be applied towards the new rental. If through no fault of your own, the reservation is not available and additionally no replacement term or property is available, then you will be refunded the entire deposit and any fees paid towards that reservation. You are advised to cooperate fully and in a timely manner with our reservation policy & terms/conditions to avoid any unforeseen circumstances regarding your vacation rental.
AGE REQUIREMENTS:
Tenant affirms that he/she is an adult and that the property will not be occupied by any minor unless and adult is present. Agent reserves right to withhold keys at time of check-in, if any misrepresentation was made by tenant and tenant would forfeit any and all monies/fees paid to Prudential Zack Shore Properties
RESTRICTIONS
Guests are required to abide by the rules of the property in which you are staying and comply with lease requirements. Failure to do so may end in forfeiture of security deposit. Please note minimum night stay and maximum occupancy for this property. Please see our “tips for tenants” page for full details of guest expectations while occupying rental property.
ACCESS:
It is agreed that the Broker shall have the right to enter the premises during the term of this lease with prospects for rental or sale.
NOTICE:
By giving your credit card number, you agree to the above stated policies. You also agree that all information given is correct. The leasehold must also be named on the credit or debit card used for the transaction. Persons obtaining reservations under false pretenses will be subject to forfeiture of deposit and the party will not be permitted keys at time of check-in.
